Walter G. Quick commenced an action against Benedictine Sisters Hospital Association, a corporation, d.b.a. St. Mary's Hospital, which owns and operates St. Mary's Hospital in the city of Duluth. It specializes in the care of patients suffering from mental and nervous disorders. Between October 3 and October 25, 1955, plaintiff was a patient in said hospital for treatment of a marked paranoid condition. During this time he was given a series of electroconvulsive shock treatments. Plaintiff alleged that defendant was guilty of negligence in the care afforded him because its employees failed to provide adequate and necessary safeguards for his protection; that as a result he fell from the hospital bed to the floor and suffered a fracture of the right shoulder for which he sought damages.
